Student Loan Issues

Providing Support.

The Legal Aid Society of San Bernardino specializes in aiding clients overwhelmed by student loan debt or those who have been victims of for-profit colleges engaging in unethical or unlawful activities. Our focus is on providing support to individuals who are financially unable to manage their student loan repayments, particularly if they’ve been affected by predatory, misleading, or illegal practices from educational institutions.
Student Loan Empowerment Project (Stream 1: Network Coordination Grants)

We could potentially provide assistance if:

  • You are in default on your student loans;
  • You went to a college that closed;
  • You did not have a valid high school diploma or GED
  • before you enrolled in your school and received federal financial aid;
  • You went to a college that you believe lied to you or did not provide what it promised;
  • You have student loans and you are disabled;
    You have been sued for repayment on your student loans or by your school;
  • You cannot afford your monthly student loan payments; or
  • You have other student loan-related questions or problems.

If you are eligible, we may be able to tell you about your rights and options, help you fill out required paperwork, and in some cases represent you.

California Student Borrower Bill of Rights
  • Prohibits servicers from engaging in abusive, unfair or deceptive practices and requires that they work in “best financial interest” of borrowers.
  • Servicers must provide borrowers with information and applications for Income-Driven Repayment plans and other forms for federal benefits and protections.
  • Establishes special protections form ilitary borrowers, borrowers working in public service, older borrowers, and borrowers with disabilities.
  • Protect borrowers from any negative consequences stemming from a sale, assignment, transfer, system conversion, or payment made by the borrower to the original student loan servicer consistent with the original student loan servicer’s policy.
  • Borrowers can file a complaint with DFPI

California is only one of 13 states that has established advanced legislation to strengthen oversight of student loan servicers and protect borrowers.
